{"id":11272,"date":"2026-06-10T13:30:03","date_gmt":"2026-06-10T13:30:03","guid":{"rendered":"https:\/\/rojas-lawfirm.com\/?p=11272"},"modified":"2026-06-10T13:30:03","modified_gmt":"2026-06-10T13:30:03","slug":"bolivia-approves-credit-refinancing-and-rescheduling-measures-for-borrowers-affected-by-social-conflicts-roadblocks-and-adverse-events","status":"publish","type":"post","link":"https:\/\/rojas-lawfirm.com\/en\/bolivia-approves-credit-refinancing-and-rescheduling-measures-for-borrowers-affected-by-social-conflicts-roadblocks-and-adverse-events\/","title":{"rendered":"Bolivia Approves Credit Refinancing and Rescheduling Measures for Borrowers Affected by Social Conflicts, Roadblocks and Adverse Events"},"content":{"rendered":"<p><strong>Bolivia Approves Credit Refinancing and Rescheduling Measures for Borrowers Affected by Social Conflicts, Roadblocks and Adverse Events<\/strong><\/p>\n<p>Supreme Decree No. 5630 establishes a financial relief framework requiring financial intermediation entities and financial leasing companies to process refinancing and\/or rescheduling requests from affected borrowers.<\/p>\n<p>On 8 June 2026, Bolivia approved <strong>Supreme Decree No. 5630<\/strong>, aimed at supporting the economic recovery of borrowers in the financial system whose payment capacity has been affected by social conflicts, roadblocks and\/or adverse events.<\/p>\n<p>The Decree requires <strong>financial intermediation entities<\/strong> and <strong>financial leasing companies<\/strong> to process voluntary refinancing and\/or rescheduling requests submitted by affected financial clients.<\/p>\n<p>The framework introduces rules on grace periods, extension periods, credit classification, adjusted payment schedules, documentation costs, insurance, internal procedures and supervision by ASFI.<\/p>\n<ol>\n<li><strong> Purpose of Supreme Decree No. 5630<\/strong><\/li>\n<\/ol>\n<p>The Decree seeks to support the economic recovery of borrowers whose payment capacity has been affected.<\/p>\n<p>To that end, financial institutions and financial leasing companies must:<\/p>\n<ul>\n<li>receive refinancing and\/or rescheduling requests;<\/li>\n<li>evaluate the borrower\u2019s economic situation;<\/li>\n<li>agree on conditions adjusted to the borrower\u2019s new payment capacity;<\/li>\n<li>approve the relevant arrangements where applicable.<\/li>\n<\/ul>\n<p>The measure applies to financial clients that voluntarily request the benefit and have been affected by social conflicts, roadblocks and\/or adverse events.<\/p>\n<ol start=\"2\">\n<li><strong> Refinancing and rescheduling: general scope<\/strong><\/li>\n<\/ol>\n<p>The Decree provides that financial institutions must agree with borrowers on the refinancing and\/or rescheduling of credit operations based on their economic situation.<\/p>\n<p>Refinancing must consider, at minimum, a <strong>temporary deterioration in the borrower\u2019s payment capacity<\/strong>. However, refinancing does not apply to financial leasing operations, although such operations may be subject to rescheduling under the Decree.<\/p>\n<p>The term of the new conditions will be determined in accordance with the internal policies and procedures of financial institutions and financial leasing companies.<\/p>\n<p>Importantly, refinancing and\/or rescheduling <strong>does not automatically result in the reclassification of the financial client into a higher-risk category<\/strong>.<\/p>\n<ol start=\"3\">\n<li><strong> Payment schedule adjusted to the borrower\u2019s capacity<\/strong><\/li>\n<\/ol>\n<p>The new payment schedule must be adjusted to the debtor\u2019s payment capacity, considering the borrower\u2019s specific circumstances.<\/p>\n<p>This requires a case-by-case assessment and a structure that enables the borrower to meet obligations under terms compatible with the borrower\u2019s economic situation.<\/p>\n<p>Financial clients that access refinancing or rescheduling may also make capital repayments at any time, in accordance with ASFI rules on early capital payments.<\/p>\n<ol start=\"4\">\n<li><strong> Grace periods and extension periods<\/strong><\/li>\n<\/ol>\n<p>One of the main components of the Decree is the possibility of including grace and\/or extension periods, together with other relief measures favourable to borrowers.<\/p>\n<p><strong>Grace period<\/strong><\/p>\n<p>The grace period may be granted for up to <strong>six months<\/strong>, counted from the approval of the refinancing and\/or rescheduling.<\/p>\n<p>During this period, the borrower is not required to pay:<\/p>\n<ul>\n<li>principal;<\/li>\n<li>interest;<\/li>\n<li>insurance;<\/li>\n<li>commissions;<\/li>\n<li>other charges linked to the refinanced or rescheduled operation.<\/li>\n<\/ul>\n<p>The payment schedule must reflect the grace period in a transparent, complete and clear manner.<\/p>\n<p><strong>Extension period<\/strong><\/p>\n<p>The extension period covers the time during which the borrower is processing the refinancing and\/or rescheduling request.<\/p>\n<p>During this period, the financial institution or financial leasing company may not collect principal, interest, insurance, commissions or other charges, or modify the status of the credit obligation, until the operation is completed or rejected with due justification.<\/p>\n<p>The transitional provision states that the extension period starts on the publication date of the Decree and may last up to <strong>30 calendar days<\/strong>, during which borrowers must approach the institution to process their request. The period may be extended by the institution in accordance with its internal policies and applicable regulations.<\/p>\n<ol start=\"5\">\n<li><strong> Treatment of interest, insurance, commissions and charges<\/strong><\/li>\n<\/ol>\n<p>The Decree provides that interest, insurance, commissions and other charges not paid during the grace and extension periods will be collected starting <strong>three months after the end of the grace period<\/strong>.<\/p>\n<p>These amounts will be prorated across subsequent instalments, and the loan term may be extended to adjust the instalment amount to the borrower\u2019s payment capacity.<\/p>\n<p>The interest rate applicable to refinanced or rescheduled operations must be the last rate applied and under the same agreed conditions, unless the client negotiates a more favourable rate.<\/p>\n<p>Financial institutions and financial leasing companies must also bear the costs of preparing minutes, addenda and documents issued for the refinancing or rescheduling.<\/p>\n<ol start=\"6\">\n<li><strong> Procedure and obligations of financial institutions<\/strong><\/li>\n<\/ol>\n<p>The Decree imposes relevant operational obligations on financial intermediation entities and financial leasing companies.<\/p>\n<p>They must adapt their internal credit analysis processes and restructure them to ensure timely, agile and diligent processing of requests, including through information and communication technologies where appropriate.<\/p>\n<p>They must also:<\/p>\n<ul>\n<li>publish access requirements on their website;<\/li>\n<li>provide the requirements when borrowers visit their offices;<\/li>\n<li>disseminate and provide financial education on the Decree;<\/li>\n<li>train their staff;<\/li>\n<li>provide equitable and non-discriminatory treatment;<\/li>\n<li>deliver clear, complete, understandable, timely and accessible information;<\/li>\n<li>keep records and controls of requests made, approved and rejected.<\/li>\n<\/ul>\n<p>ASFI is responsible for controlling and supervising compliance with the Decree.<\/p>\n<ol start=\"7\">\n<li><strong> Credit-related insurance<\/strong><\/li>\n<\/ol>\n<p>The Decree also regulates insurance linked to refinanced and\/or rescheduled credit operations.<\/p>\n<p>Insurance companies must adjust the payment of premiums for mortgage life insurance and insurance covering credit guarantees, without this resulting in cancellation of the insurance.<\/p>\n<p>The coverage of mortgage life insurance policies and policies covering credit guarantees remains fully in force during the grace and\/or extension period, without payment requirements, surcharges, default interest or modification of coverage.<\/p>\n<p><strong>Practical implications for borrowers and financial institutions<\/strong><\/p>\n<p>Supreme Decree No. 5630 has practical implications for both borrowers and financial institutions.<\/p>\n<p>For borrowers, the Decree may allow them to:<\/p>\n<ul>\n<li>adjust loans to their new payment capacity;<\/li>\n<li>access grace or extension periods;<\/li>\n<li>avoid automatic deterioration of credit classification;<\/li>\n<li>temporarily defer payments of principal, interest, insurance and other charges;<\/li>\n<li>make early capital repayments;<\/li>\n<li>preserve insurance coverage during the relief period.<\/li>\n<\/ul>\n<p>For financial institutions, the Decree requires them to:<\/p>\n<ul>\n<li>adapt internal procedures;<\/li>\n<li>publish requirements;<\/li>\n<li>train staff;<\/li>\n<li>assess requests on a case-by-case basis;<\/li>\n<li>document approvals and rejections;<\/li>\n<li>provide clear information and equitable treatment;<\/li>\n<li>coordinate with insurance companies;<\/li>\n<li>comply with ASFI supervision.<\/li>\n<\/ul>\n<p><strong>Conclusion<\/strong><\/p>\n<p>Supreme Decree No. 5630 establishes a financial relief measure for borrowers affected by social conflicts, roadblocks and\/or adverse events that have reduced their payment capacity.<\/p>\n<p>The Decree does not provide for debt forgiveness or a general automatic suspension of payments.
