Supreme Decree 4896 – Service of Access to Justice System and Public Registry of Attorneys SAJS-PRA

On March 22, 2023, the Executive Branch published Supreme Decree 4896 (“SD”), which provides the following:

It creates the Service of Access to Justice System and Public Registry of Attorneys (“SAJS-PRA”), as well as providing the necessary functions to promote and manage the access to justice services, within the framework of the social purpose of the legal profession.

Functions of the SAJS-PRA

The SAJS-PRA holds the following functions:

a) Channel requests for access to justice and, if applicable, provide comprehensive justice services;
b) Establish, regulate, and manage the Inter-institutional Network for Access to Justice (“INAJ”);
c) Implement operational and technological mechanisms that facilitate the management, integration, referral, and proper care of comprehensive justice services, within the INAJ;
d) Manage and implement interoperability mechanisms with public and private entities for the proper performance of the INAJ;
e) Oversee and evaluate the provision of services of the entities that are part of the INAJ;
f) Follow-up on the demand for comprehensive justice services at the national level for the application of measures that allow an adequate and timely attention;
g) Assist in the development of technological solutions aimed at modernizing institutional and management processes, as well as public services, in order to increase efficiency, transparency and accessibility, within the framework of access to justice and government policies current email;
h) Manage the Public Registry of Attorneys;
i) Manage the mechanisms and instruments for the processing of complaints for violations of ethics and the proper functioning of the Ethics Tribunals of the Legal Profession;
j) Verify that the attorneys have the training and experience, safeguarding the social function of public interest that the practice of law represents;
k) Establish actions and mechanisms for training and updating knowledge for attorneys;
l) Generate the means and instruments of verification of the effective compliance of Law 387, dated July 9, 2013, which rules the legal practice and its regulations, by attorneys and public and private institutions;
m) Set out follow-up actions and mechanisms aimed at regulating the appropriate professional legal practice.

Organizational Structure of the SAJS-PRA

a) The SAJS-PRA is headed by an Executive General Director, appointed by the Minister of Justice and Institutional Transparency through a Ministerial Resolution.
b) The organizational structure of the SAJSPRA shall be approved by Ministerial Resolution, within the framework of current regulations.
